IRS Tax Lien in Oklahoma – What It Means and How to Get It Removed

What Is an IRS Tax Lien?
A federal tax lien is a public legal claim by the IRS against:
- Your
personal property
- Real estate
- Business assets
- Future income or settlements
It’s the IRS’s way of saying:
“You owe us, and we have first rights to your assets if you sell or refinance.”
It’s different from a levy:
- A
lien is a
claim (not a seizure)
A
levy is an
action (like a wage garnishment or bank levy)
How Do You Know a Lien Has Been Filed?
The IRS files a Notice of Federal Tax Lien (NFTL) in the county recorder’s office (and sometimes with the Secretary of State). You may be notified by:
- IRS Letter 3172
- A denial of credit, loan, or mortgage application
- Your escrow or title company during a refinance
- A search of public records
What Problems Do IRS Liens Cause?
- Kills home refinancing or HELOC approval
- Prevents
business lending or bonding
- Public record that may show up on background checks
- Blocks you from selling property without satisfying the lien
- Stays attached to
assets until paid or removed
The longer it’s on record, the harder it is to recover financially.
How to Remove or Release an IRS Tax Lien
1. Pay the Full Balance
Paying the debt in full automatically releases the lien — the IRS files a release within 30 days. But this isn’t always realistic.
2. Set Up an Installment Agreement
Certain streamlined Installment Agreements (typically under $50,000) allow for lien withdrawal if:
- You make 3 consecutive payments
- You file Form 12277 (Request for Withdrawal)
- Your payments are on auto-debit (Direct Debit IA)
3. Submit an Offer in Compromise
If accepted, the IRS will release the lien upon successful settlement.
4. Request a Withdrawal (in special cases)
Even if the lien is valid, you may request a withdrawal if:
- It helps you get approved for a loan
- You’re in compliance and actively resolving the debt
- Public interest is better served by removing it
5. Discharge or Subordinate (for property sales/refi)
We can help request a
discharge of the lien from a specific property (to allow sale/refinance) or a
subordination (so a new lender can take priority).

FAQ
How long does a federal tax lien stay on record?
Until the debt is paid or officially released. Even if the statute expires, the lien must be removed manually.
Will the IRS remove a lien automatically?
Only after full payment. Withdrawal or early removal requires a formal request and eligibility.
Can I refinance my house with a lien?
Possibly — we can request subordination to allow a new mortgage or HELOC.
Is a tax lien public?
Yes. It’s recorded with your county and may show up on title reports, background checks, and financial applications.
