How to Stop an Oklahoma Tax Commission Wage Garnishment

If you opened your paycheck and found money missing — and it wasn’t the IRS — there’s a good chance it was the Oklahoma Tax Commission (OTC).
Unlike the IRS, the OTC can levy wages fast, without warning, and collect aggressively.
At Summit Tax Relief, we help Oklahoma taxpayers stop wage garnishments, get relief from collection pressure, and negotiate affordable repayment plans that actually work.
Here’s what you need to know — and how to protect your next paycheck.
How OTC Wage Garnishments Work
The OTC can garnish wages under 68 O.S. § 2702. Once a tax liability is assessed and not paid:
- They issue a Notice of Intent to Levy or Garnish Wages (sometimes skipped)
- A Garnishment Notice (Form OTC-504 or OTC-505) is sent to your employer
- Your employer is required by law to:
- Withhold a portion of each check
- Send it directly to the OTC
- Provide a copy to you
Unlike the IRS, the OTC does not use exemption tables — instead, they typically garnish a fixed percentage of gross pay.
How Much Can They Take?
OTC wage garnishment usually takes:
- 25% of disposable earnings, or
- The amount over 30 times the federal minimum wage, whichever is less
However, in practice, many Oklahoma employers simply deduct 25% across the board — regardless of your living expenses.
This means even lower-income workers can lose hundreds of dollars per paycheck.
How to Stop or Reverse OTC Garnishment
Summit Tax Relief has helped hundreds of Oklahoma clients stop wage garnishments fast — usually within 2–5 business days.
Step 1: File a Power of Attorney
We take over all communication with the OTC and your employer — immediately.
Step 2: Request a Garnishment Release
We file a formal release request with the OTC collections division — citing hardship, compliance steps, or planned resolution.
Step 3: Submit Missing Returns or Documentation
No relief will be granted if you’re non-compliant. We file all missing returns first.
Step 4: Negotiate a Payment Plan or Offer
Once you’re compliant, we propose:
- An Installment Agreement
- Offer in Compromise (in hardship cases)
- Temporary Hardship Status in extreme situations
Oklahoma Case Example
Client: Warehouse employee in Lawton, OK
- Owed $12,000 in back income tax from a previous job
- OTC began garnishing 25% of wages — $312 every paycheck
- We filed POA, submitted missing returns, and proposed $125/mo plan
- Garnishment released in 4 days, payment plan approved within 2 weeks
What Happens If You Do Nothing?
- OTC will continue garnishment until the full debt is paid
- They may also file tax warrants (liens), freeze bank accounts, or revoke licenses
- Employers are legally obligated to comply — or risk being held liable
- You may be left with insufficient income to meet basic needs
