IRS Wage Garnishment – How It Starts and How to Stop It

Few IRS enforcement actions are as stressful — or as disruptive — as wage garnishment.

You check your bank account… and it’s short.
You call your payroll department… and they tell you the IRS took part of your check.
It’s already happening — and it doesn’t stop until the debt is paid.

But here’s the good news:

IRS wage garnishment can be stopped — often within 24–48 hours — if you take the right action.

This guide explains how IRS wage garnishment works, how much they can legally take, and how to stop it with help from Summit Tax Relief.

What Is IRS Wage Garnishment?

Wage garnishment is when the IRS forces your employer to withhold part of your paycheck and send it directly to the government to pay your tax debt.

This happens when:

  • You owe back taxes

  • You ignore IRS collection notices

  • You fail to respond to a Final Notice of Intent to Levy (LT11 or Letter 1058)

The IRS doesn’t need a court order. Once they issue the final notice and wait 30 days, they can garnish your wages without any further warning.

How Much of Your Paycheck Can the IRS Take?

The IRS doesn’t take a percentage — they leave you with a small exempt amount based on:

  • Filing status (single, married, head of household)

  • Number of claimed dependents

  • Pay frequency (weekly, biweekly, etc.)

Everything else? They can take.

For example:

  • A single person with no dependents might be left with just $260/week

  • The rest goes to the IRS — every paycheck — until the debt is satisfied

And yes, bonuses, commissions, and overtime are all subject to garnishment.

How Long Does IRS Garnishment Last?

It doesn’t go away on its own.

The garnishment continues until:

  • You pay your full IRS balance

  • You enter into a formal resolution (like an OIC or installment agreement)

  • You qualify for hardship status (CNC)

  • You file bankruptcy (if applicable)

  • You get it lifted through intervention (like we do at Summit Tax Relief)

Real Client Example (Nationwide)

Client: Medical sales rep, Texas

  • Owed $42,000 in back taxes

  • Ignored multiple IRS notices

  • Employer notified by IRS; garnishment started

  • We filed POA same day, requested levy release

  • Submitted financials proving hardship

  • IRS released wage levy within 36 hours

  • Client entered into $185/month installment plan

What Notices Come Before Garnishment?

Before the IRS garnishes your wages, they must send:

  1. CP14 – Initial balance due notice

  2. CP501/CP503 – Reminder notices

  3. CP504 – Notice of Intent to Levy (state refund only)

  4. LT11 or Letter 1058 – Final Notice of Intent to Levy

  5. 30-day waiting period (for CDP hearing request)

Once the 30 days expire and no CDP hearing is requested, the IRS can start garnishment at any time.

How to Stop IRS Wage Garnishment

1. Request a CDP Hearing (Form 12153)

If you're still within the 30-day window from the Final Notice, file Form 12153 immediately. This pauses collection and forces the IRS to halt garnishment.

2. Submit Financial Documentation (Form 433-A or 433-F)

This proves your income, expenses, assets, and liabilities. The IRS uses this to determine whether to:

  • Remove the garnishment

  • Approve a payment plan

  • Consider an Offer in Compromise

  • Place you in Currently Not Collectible (CNC)

3. Request a Levy Release

If garnishment has already started, we request a levy release by:

  • Proving hardship

  • Offering a good-faith resolution

  • Filing necessary documents on your behalf

4. Propose a Resolution

We negotiate with the IRS to:

  • Secure an Installment Agreement

  • Submit an Offer in Compromise

  • Classify you as Currently Not Collectible
